Student Rights Upheld in Charter School Discipline Case
In a recent case handled by K Altman Law, a Texas charter school’s expulsion decision was overturned after serious concerns were raised about due process violations and misapplication of state law. A student admitted to using a vape that tested positive for THC. However, the school’s response included an expulsion which violated both its own policies and provisions of the Texas Education Code.
Our team identified multiple issues, including failure to disclose evidence before the Level I disciplinary hearing, misrepresentation of state law regarding mandatory expulsion, and the omission of critical factors such as the student’s disciplinary and academic record. During the Level II appeal, school officials acknowledged procedural missteps, especially when pressed about their delayed timeline and incomplete presentation of information to the disciplinary panel.
Ultimately, the expulsion was reversed, with school leaders citing concerns we raised about the integrity of their disciplinary procedures as a key factor. This outcome reinforces the importance of legal compliance in student discipline and the need for schools; charter or otherwise to uphold due process and align with restorative legislative intent.
